Voting 5 to 4, the high court declared that automatically sentencing someone so young to a lifetime behind bars ? with no future prospect than to die in prison ? is cruel and unusual punishment in violation of the Constitution?s Eighth Amendment.
?The Eighth Amendment forbids a sentencing scheme that mandates life in prison without the possibility of parole for juvenile offenders,? Justice Elena Kagan wrote in the majority decision.??A judge or jury must have the opportunity to consider mitigating circumstances before imposing the harshest possible penalty for juveniles,? she said.
Justice Kagan said mandatory sentencing provisions eliminate the ability of a sentencing court to take into consideration all mitigating circumstances about a juvenile?s life and involvement in the crime before concluding that life without parole is appropriate punishment for a young offender.
?Although we do not foreclose a sentencer?s ability to make that judgment in homicide cases, we require it to take into account how children are different, and how those differences counsel against irrevocably sentencing them to a lifetime in prison,? she wrote.
Two justices, Stephen Breyer and Sonia Sotomayor, favored imposing a blanket ban on all life-without-parole sentences for juveniles. While rejecting that option, Kagan noted: ?We think appropriate occasions for sentencing juveniles to this harshest possible penalty will be uncommon.?
Kagan said juvenile offenders should not be punished as harshly as adults, because they are generally less culpable than adults for their crimes, and enjoy a higher capacity to change. Studies have shown that judgment and character are not fully formed until an individual reaches his or her 20s.
The high court used that same rationale concerning the development of the brain and emotional maturity to justify two other landmark rulings ? declaring the death penalty for juvenile offenders unconstitutional in 2005 and deciding in 2010 that sentencing a juvenile to life without parole for a non-homicide crime violated the Eighth Amendment.?
The deciding fifth vote in all three cases was cast by the same justice, Anthony Kennedy.
In a dissenting opinion, Chief Justice John Roberts said the Monday decision is not a logical extension of the court?s earlier holdings in 2005 and 2010.
?Those cases undoubtedly stand for the proposition that teenagers are less mature, less responsible, and less fixed in their ways than adults ? not that a Supreme Court case was needed to establish that,? he said.
?What they do not stand for, and do not even suggest, is that legislators ? who also know that teenagers are different from adults ? may not require life without parole for juveniles who commit the worst types of murder,? he said.

Prudential Mortgage Capital Company has closed a $ 108 million commercial real estate loan in the U.K., the first financing since launching its European business earlier this year. Prudential Mortgage Capital Company is the commercial mortgage lending business of Prudential Financial, Inc. (NYSE: PRU).
The loan is secured by a portfolio of U.K. properties: four multi-tenanted office properties in central London and a grocery-anchored retail property in the historic town of Bath. The 11-year financing marks Prudential?s first secured commercial real estate debt transaction in Europe since the opening of its London advisory office in January 2012. The portfolio?s sponsor, the O&H Group, is a family run business with considerable real estate holdings and development projects in central London and throughout the U.K.
In 2012 Prudential is targeting $ 500 million (?325 million, ?400 million) of long-term, fixed-rate senior debt transactions in Europe, with the ability to do significantly more than this. The European program is similar to the loan structures the company offers in the U.S., and as in the U.S., there is the ability to fund individual transactions of significant size. NEW YORK (AP) ? A spokeswoman says "Jeopardy!" host Alex Trebek is "up and about" in a Los Angeles hospital as he recovers from a mild heart attack.
Sony Pictures Television spokeswoman Paula Askanas said Monday that Trebek is "in good spirits" while doctors complete their tests. She says he has been moved to a regular room.
The 71-year-old Trebek was admitted to Cedars-Sinai Medical Center on Saturday. He's expected to fully recover and be back at work when "Jeopardy!" resumes production for a new season in July.
Trebek was hospitalized for a heart attack in 2007. He has been hosting the popular quiz show for 28 years.

WASHINGTON (AP) ? Metal hip replacements implanted in a half-million Americans may be failing earlier than expected, but it could be years before U.S. health regulators have a clear picture of the problem.
The Food and Drug Administration holds a two-day meeting starting Wednesday to scrutinize the safety of metal-on-metal hip implants, following years of patient reports of pain and swelling that sometimes requires removal of the devices. It is a challenging, but familiar, predicament for the FDA: reviewing the safety of a device that was expected to be superior, but which may actually be more dangerous than what came before.
For decades nearly all orthopedic implants were made from plastic or ceramic. But in the last 10 years some surgeons began to favor implants made with metal stems and sockets. Laboratory tests suggested the devices would be more resistant to wear and reduce the chances of dislocation.
But recent data gathered by surgeons in the U.K. appears to show just the opposite.
In March, British experts at the world's largest artificial joint registry told doctors to stop using metal-on-metal hip replacements, citing an analysis showing they have to be replaced more often than other implants. Hip replacements are supposed to last between 10 to 15 years, but more than 6 percent of patients with metal hips needed them replaced after less than five years. That compared with just 2 percent of people who had ceramic or plastic joints. Both types of devices are prescribed for people suffering hip pain and limited movement due to arthritis or injury.
British regulators now recommend that people who have the implants get yearly blood tests to make sure no dangerous metals are seeping into their bodies as the components rub against each other.
The FDA has not made any recommendations of its own for the estimated 500,000 American patients with the devices.
FDA scientists say they want to consider all available information before making their recommendations ? not just the data from the U.K.
"Why look at a single registry when there's data from around the world?" said Dr. William Maisel, FDA's chief scientist for medical devices, in an interview with the Associated Press. "This is an opportunity for us to look at all the available information so that we can have a thoughtful conversation about what clinical recommendations can be made."
Maisel said the FDA is working to combine data from foreign countries and the U.S. to determine which groups of patients and implants are most problematic. On Wednesday and Thursday the FDA will ask a panel of experts to recommend the best practices for monitoring patients with the devices. Panelists will consider blood tests, medical imaging and laboratory tests.
But some U.S. orthopedic specialists say they have already reached their own conclusions about metal hips.
"In my personal opinion there is very little room, if any, for metal-on-metal implants because the alternatives we have on the market are likely safer and as effective," said Dr. Art Sedrakyan, professor of public health at Weill Cornell Medical College in New York.
The FDA's deliberative approach to tackling the hip implant issue is in some ways a necessity. Unlike other countries, the U.S. has no national registry to track the performance of implants over time.
The FDA received 16,800 negative event reports involving metal hips between 2000 and 2011, but regulators stress that number is not very useful. Many doctors do not report problems to the FDA, and the volume of reports is influenced by news reports on safety issues.
A registry set up by Minnesota's HealthEast Care System recorded four times as many replacement surgeries for patients with metal-on-metal hips as those with other implant types. However, a similar registry set up by health care provider Kaiser Permanente found no difference between the two groups.
With little definitive data on U.S. hip implants, the agency has asked manufacturers like Johnson & Johnson, Zimmer Holdings Inc. and Biomet Inc. to conduct long-term, follow-up studies of more than 100 metal-on-metal hips on the U.S. market.
FDA scientists say the studies will help "fill in the blanks" on a number of scientific questions, including the effects of metal particles that often seep into the bloodstream as the implants wear down.
But Sedrakyan and others say it could be a decade or more before that information is available. In a commentary published last week in the New England Journal of Medicine, Sedrakyan and two co-authors pointed out those studies must run at least eight years to return the information FDA is seeking. Based on the authors' analysis of FDA records, the FDA has reached agreements on the design of less than 25 percent of the studies, and it's unclear whether any of the studies have actually begun. The FDA notified the companies last May.
The prospect of safety findings arriving in eight or 10 years is little comfort to patients like Mary Weaver, 48, who had both hips replaced with a metal implant from Johnson & Johnson in 2007 and 2008. J&J recalled the ASR hip replacement in 2010, after reports that it was failing in some patients after only a few years of implantation.
Due to increasing pain and elevated metal levels in her blood, Weaver had both implants removed in 2011. She was let go from her job due to the time needed to undergo both surgeries, and is currently unemployed.
"I hope that no one has to go through this ? it's frustrating, it's emotionally draining," said Weaver, who lives in Mount Jackson, Va. "It's not just hard on you, it's hard on your whole family because your quality of life is not what it used to be."
Like 90 percent of medical devices sold in the U.S., most metal-on-metal hips were approved via the FDA's fast track program for medical devices. Under the so-called 510k system, the agency waives clinical testing requirements for devices which appear similar to others already in use. Since plastic and ceramic hip replacements had been on the market since the 1950s, most metal hip replacements were approved without new clinical testing.
"I am so furious they would use my wife as a lab rat, along with the other 500,000 people who don't have a clue what is happening," said Dwight Schrag, 69, of Bellevue, Wash. Schrag's wife Mary received J&J's ASR hip in 2006 and had it removed due to pain and other side effects in 2010. Schrag is one of a number of speakers who have signed up to speak during a public comment session at the FDA meeting.
It's not the first time the FDA's fast-track program for clearing devices has come under fire.
Last summer the Institute of Medicine said in a report that the FDA should abandon the 35-year-old system because it provides little assurance that the implants are actually safe. The Institute is composed of medical experts who advise the federal government.
Although the FDA itself requested the report from the Institute, agency officials rejected the group's conclusions, saying the 510k system works well for the vast majority of devices.

DENVER (AP) ? A Denver police officer trying to break up a confrontation was shot and killed Sunday at a city park where hundreds of families had gathered for a free weekly jazz concert before gunfire erupted and sent hundreds fleeing.
The officer, who was shot in the head, was taken to a hospital where she was pronounced dead, police spokesman Sonny Jackson said. Police were searching for a suspect in what Jackson described as an isolated incident.
At least three shots were fired shortly after the jazz band playing on a lake-side pavilion stage finished, sending waves of people running through park grounds where some concert goers who were initially unaware of the shooting remained seated on picnic blankets and lawn chairs.
More than 1,000 people were at the City Park Jazz concert, the fourth of 10 shows scheduled for this summer in the annual series that draws families and people of all backgrounds to one of the city's more popular summer events. The mayor said late Sunday that the concerts should continue.
"We will not surrender what we consider special in this city to anyone," Denver Mayor Michael Hancock said.
Nakira Doss, a jazz singer herself, said she hopes the series continues. The 28-year-old mother was at the show Sunday and sitting near the stage with her children, ages 4, 5 and 7, when she heard at least two shots. As people ran past, she said told her children to "get on the ground" and then she laid herself over them.
"I'm trying to show them music, but at what cost," she said, nodding toward her own children.
City Park is one Denver's most famous and sprawls across several hundred acres east of downtown. It holds the Denver Zoo, Museum of Nature and Science, as well as ponds, trails and recreational fields.
After shots rang out, scores of people ran from the northwest side of the pond and stage area, confusing crowds on the south side of the pond who were still lingering over conversation and picnics in lawn chairs and blankets. Someone announced from a loudspeaker on stage that the park was closed and told park goers to leave from the south side.
Nakira Doss, 28, was sitting near the stage when she heard at least two shots. She said she covered her three children, ages 7, 5 and 4, as other concertgoers ran past.
Samuel Bell, 19, of Denver, said he was in the parking lot looking for a space for his scooter, which police later cordoned off with yellow tape. He said he heard several shots.
"We just arrived at the park. It was crowded, it was looking fun," Bell said. "And then 'pa- pa-pa-pa' outta nowhere.
"We just ducked," Bell said. "We pulled off in enough time to get away. It was crazy."
He said he saw police officers administering CPR. He estimated he was about 10 to 20 feet away from where the officer was shot.

U.S. Army Spc. Nick Mapson is the recipient of the LIFEhouse. Mapson suffered debilitating injuries in Afghanistan in July 2004 and is the deserving recipient. He was driving a truck that was blown up by anti-tank mines. In the explosion?s aftermath, Mapson was trapped in the truck, became drenched in diesel fuel and caught on fire. He forced open a door to escape the burning truck, put out the fire that engulfed him, and without medication endured the wait for a helicopter pickup and subsequent hour-long ride to a hospital.
He was placed in a medically induced coma, stabilized and flown to Germany, where his parents were asked to come to say goodbye because of Mapson?s critical injuries. But he survived and was flown to Texas for medical treatment. The explosion and subsequent fire left him with third-degree burns to his face, arms and hands, much hearing loss, reduction in eyesight, back-disc bulging, herniation and other injuries.
Just as bravely as Mapson defended his country he has fought through his injuries, undergoing numerous skin grafts and continuing rehabilitation during months in hospitals. He experiences constant pain, especially in his hands, which lack a range of motion. He earned a Purple Heart and other U.S. commendations for his meritorious service. Mapson is one of the more than 48,000 U.S. veterans who have been wounded in Iraq and Afghanistan.
Mapson and his wife and two children presently live in Sugar Grove, Ill.
Built for a wounded veteran?s needs
The ranch-style LIFEhouse, at 1,992 square feet plus a finished basement, features an open floor plan with wide doorways and circulation areas. The specially designed entrances, kitchen and bathrooms are accessible for a physically challenged veteran.

Wausau Supply, one of the Midwest?s largest building supply companies, is donating the siding?s prefinishing, which is advertised to have a virtually maintenance-free finish and a 30-year no-fade warranty.
The LIFEhouse team
The site of the LIFEhouse announcement was The Highlands of Elgin, in Elgin, Ill., at the annual golf event of the Home Builders Association of Greater Chicago (HBAGC) and Residential Construction Employers Council, Chicago.
This home is part of the national Touchdown for Homes project and locally involves the HBAGC, the Chicago NFL Players Association (NFLPA) Former Players Chapter (of which Reggie Smith is president) and New American Homes.
Susanne Tauke, president of New American Homes Inc., said, ?LIFEhouse began when our company collaborated with the Center for Inclusive Design and Environmental Access (IDEA) at the University of Buffalo, State University of New York, which is a pioneer in architecture and design work in accessibility. Our first LIFEhouse won the 2012 Best of 50-Plus Housing Award from the National Association of Home Builders. This led to the anonymous donor providing the seed money to build the LIFEhouse for a Hero.
?The anonymous donor was overwhelmed with emotion after reading Nick Mapson?s story. The donor chose Nick for the LIFEhouse, and like everyone associated with this effort is extremely grateful for his sacrifices.?
Tauke will meet with Mapson to determine if the LIFEhouse can be customized even more to serve his needs.
Mapson, in his application for the LIFEhouse, wrote, ?Life would be a lot easier with handles and grips to hold onto, and the user-friendly equipment would greatly help as well. Just being able to have a sense of security to give my family would mean the world to me. I am very grateful to have organizations like yours available for us severely wounded veterans. It truly means the world to us.?
Rita Unzner, executive director of HBAGC, learned of Mapson with help from the Veterans Administration. Also aiding in selecting Mapson was Operation Finally Home (OFH), a national 501(c)(3) that provides custom mortgage-free homes to wounded and disabled veterans and the widows of the fallen. Many manufacturers have contributed to the LIFEhouse. LP? Building Products, which helps wounded veterans around the country, has provided organizational support and donated LP SmartSide? engineered wood siding and trim.
Tauke said, ?We are so grateful to the companies who are donating great easy-maintenance products for the home ? companies like LP Building Products and Wausau Supply.?
Smith said, ?It?s a privilege for the NFLPA to support Nick and his family with the LIFEhouse. We have been delighted to participate in this effort, helping bring attention to the needs of wounded veterans and to create visibility about the LIFEhouse. Former NFL players are devoted to giving back in the communities that have supported us. We honor the great sacrifices of our wounded veterans.?
Unzner said, ?It?s a unique honor to benefit Nick and his family. HBAGC members, many of whom are U.S. veterans, are indebted to veterans for their sacrifices and are very pleased to support Touchdown for Homes. We plan to continue to reach out to Nick after he gets settled in his new home to help with the transition to his new community.?
